On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas pursuant to subsection 14(1) of the Ontario Cannabis Retail Corporation Act, 2017, the Ontario Cannabis Retail Corporation (the “Corporation”) may, subject to the approval of the Lieutenant Governor in Council, establish job categories, salary ranges and conditions of employment for its employees;

And whereas pursuant to Order in Council 934/2022 dated April 7, 2022, the Corporation established job categories, salary ranges and conditions of employment for employees (the “Unionized Employees”) represented by the Ontario Public Service Employees Union, on behalf of local 553 (the “Union”) pursuant to a Memorandum of Settlement signed February 2, 2022 and its Addendum signed March 1, 2022 for the period from April 1, 2022 to March 31, 2025 which was subject to a wage re- opener in the event that Bill 124, Protecting a Sustainable Public Sector for Future Generations Act, 2019 (“PSPSFGA”) be found unconstitutional by a court of competent jurisdiction prior to the expiry of the Collective Agreement (“Collective Agreement”);

And whereas the Court of Appeal for Ontario declared the PSPSFGA unconstitutional with respect to represented employees in a decision dated February 12, 2024 (“Decision”);

And whereas the Corporation and the Union negotiated wages as a result of the Decision and reached an agreement that the Collective Agreement remain in place and unaltered, save and except the wage increases set out in a Memorandum of Settlement signed July 10, 2024 (“Memorandum”);

And whereas the Corporation wishes to maintain the job categories and conditions of employment for the Unionized Employees as set out in Order in Council 934/2022 and re-establish the salary ranges for the Unionized Employees;

And whereas the Corporation is seeking the approval of the Lieutenant Governor in Council to reestablish the salary ranges in accordance with the attached Memorandum.

Therefore:

  1. Pursuant to subsection 14(1) of the Ontario Cannabis Retail Corporation Act, 2017, the salary ranges for the Unionized Employees reestablished in accordance with the attached Memorandum are hereby approved.
