On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Pursuant to subsection 4.2 (8) of the Ontario Energy Board Act, 1998, as re-enacted by Schedule 2 of the Fixing the Hydro Mess Act, 2019, the chief executive officer of the Ontario Energy Board (“OEB”) shall, for the term of his or her appointment by the Lieutenant Governor in Council under this subsection, be entitled to remuneration as follows:

Chief Executive Officer’s remuneration:

  1. The chief executive officer shall serve in this position on a full-time basis and shall be paid annual remuneration of $320,000.
  2. The chief executive officer shall be eligible to be paid in each year, pay for performance in an amount not to exceed 25 percent of his or her annual remuneration for the year, in accordance with measures established by board of directors of the OEB.
  3. The chief executive officer’s annual remuneration, including pay for performance, shall not exceed a maximum of $400,000 in any given year.
  4. The chief executive officer shall also be eligible to participate in the OEB’s Benefit Program and Pension Tax Equalization Payment program, as established by the OEB and as may be applicable to the chief executive officer.

Expenses:

  1. In addition to the remuneration set out above, the chief executive officer shall be reimbursed for reasonable expenses incurred in carrying out his or her duties in accordance with the Management Board of Cabinet’s Travel, Meal and Hospitality Expenses Directive.

Further, this Order in Council shall be effective on the day that subsection 4.2 (8) of the Ontario Energy Board Act, 1998, as re-enacted by Schedule 2 of the Fixing the Hydro Mess Act, 2019, comes into force.
