Order in Council 1234/2021

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Ontario Heritage Trust (the “Trust”) is the registered owner of certain property municipally known as 265 Front Street East, City of Toronto and more particularly described in Schedule A (the “Lands”);

And whereas the Trust is continued as a corporation without share capital under the Ontario Heritage Act and is accountable to the Minister of Heritage, Sport, Tourism and Culture Industries;

And whereas pursuant to subsection 11(1) of the Ontario Heritage Act, the Trust is an agent of Her Majesty in right of Ontario;

And whereas pursuant to subsection 11(2) of the Ontario Heritage Act, property acquired by the Trust is the property of Her Majesty in right of Ontario;

And whereas Metrolinx is a corporation without share capital continued under the Metrolinx Act, 2006 and is accountable to the Minister of Transportation;

And whereas pursuant to subsection 3(1) of the Metrolinx Act, 2006, Metrolinx is a Crown agency within the meaning of the Crown Agency Act;

And whereas Metrolinx and the Minister of Transportation have requested that Metrolinx have administration and control of the Lands to deliver the Ontario Line project in the City of Toronto, which is a priority transit project under the Building Transit Faster Act, 2020;

And whereas under section 25.2 of the Ontario Heritage Act the Minister of Heritage, Sport, Tourism and Culture Industries has granted consent for certain activities to occur in respect of the Lands, subject to conditions;

Now therefore, pursuant to the royal prerogative and the inherent jurisdiction of the Lieutenant Governor in Council to administer the property of Her Majesty in right of Ontario, the administration and control of the Lands, together with any rights, interests, and encumbrances appurtenant to the Lands, is hereby transferred from the Trust to Metrolinx, and the Trust and Metrolinx are authorized to execute such documents as may be necessary in respect of the transfer.
