Order in Council 1277/2017

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas certain Orders in Council made under the Financial Administration Act and various Ontario Loan Acts authorize borrowing by the issue and sale of treasury bills and unsecured short-term promissory notes and by way of loan or by issue and sale of securities of Ontario on the credit of the Consolidated Revenue Fund of Ontario;

And Whereas Order in Council 521/2017 made under section 21 of the Financial Administration Act authorizes borrowing for the purpose of the payment, renewal, repayment or replacement of various loans and securities;

And Whereas certain Orders in Council made under the Financial Administration Act and section 68 of the Electricity Act, 1998, section 21 of the Capital Investment Plan Act, 1993, or subsection 23(1) of the Ontario Infrastructure and Lands Corporation Act, 2011 authorize borrowing by way of loan or the issue and sale of securities of Ontario;

And Whereas certain Orders in Council made under subsection 23(2) of the Ontario Infrastructure and Lands Corporation Act, 2011 authorize the Minister of Finance to purchase securities of or make loans to Ontario Infrastructure and Lands Corporation;

And Whereas it is desirable to amend the aforementioned existing Orders in Council to update certain authorized signing officers;

Therefore:

Orders made under the Financial Administration Act and Ontario Loan Acts

1. Amendments are made to the paragraphs immediately following paragraph 2 and paragraph 4 of Orders in Council 79/92, 318/92, 926/92, 3594/92, 1358/93, and 2096/93, each as amended, paragraphs 3 and 4 of Orders in Council 1549/2010, 1334/2012, 965/2013, 458/2015, 1241/2015, each as amended, paragraphs 3 and 4 of Order in Council 1164/2016, paragraph 3 and 5 of Orders in Council 1417/2008, 1043/2009, 1044/2009, 1048/2010, 600/2012, 966/2013, 459/2015, 460/2015, each as amended, paragraphs 4 and 6 of Order in Council 831/2008 as amended, and paragraphs 5 and 7 of Order in Council 1703/95 as amended, in each case by:
   1. deleting the words “the Executive Director” and substituting “the Executive Director and Chief Investment Officer”; and
   2. deleting the words “any Manager, Capital Markets Division” and substituting “any Senior Manager, Capital Markets Division”.

Order made under section 21 of the Financial Administration Act

2. Paragraphs 4 and 5 of Order in Council 521/2017 are each amended by:
   1. deleting the words “the Executive Director” and substituting “the Executive Director and Chief Investment Officer”; and
   2. deleting the words “any Manager, Capital Markets Division” and substituting “any Senior Manager, Capital Markets Division”.

Orders relating to the Electricity Act, 1998

3. Amendments are made to paragraphs 3, 5 and 6 of Order in Council 561/2000 as amended, paragraphs 3, 5 and 6 of Order in Council 1168/2002 as amended, and paragraphs 3, 4 and 7 of Orders in Council 967/2013, 956/2014 and 949/2015, each as amended, in each case by:
   1. deleting the words “the Executive Director” and substituting “the Executive Director and Chief Investment Officer”; and
   2. deleting the words “any Manager, Capital Markets Division” and substituting “any Senior Manager, Capital Markets Division”.

Orders relating to the Capital Investment Plan Act, 1993

4. Paragraphs 3 and 4 of Orders in Council 678/2009 and 975/2009, each as amended, are amended by:
   1. deleting the words “the Executive Director” and substituting “the Executive Director and Chief Investment Officer”; and
   2. deleting the words “any Manager, Capital Markets Division” and substituting “any Senior Manager, Capital Markets Division”.

Orders relating to the Ontario Infrastructure and Lands Corporation Act, 2011

5. Amendments are made to paragraph 2 of Orders in Council 631/2014 and 1524/2014, each as amended, and paragraphs 3, 4 and 7 of Orders in Council 1229/2013 and 632/2014 as amended, in each case by:
   1. deleting the words “the Executive Director” and substituting “the Executive Director and Chief Investment Officer”; and
   2. deleting the words “any Manager, Capital Markets Division” and substituting “any Senior Manager, Capital Markets Division”.

6. Paragraph 2 of Order in Council 1566/2016 is amended by:
   1. deleting the words “the Executive Director, Capital Markets Division, the Chief Financial and Risk Officer, Finance and Treasury Division” and substituting “the Executive Director and Chief Investment Officer, Capital Markets Division, the Chief Financial and Risk Officer”;
   2. deleting the words “any Manager, Capital Markets Division” and substituting “any Senior Manager, Capital Markets Division”.

And That this Order in Council is effective on the later of July 1, 2017 and the date this Order in Council is made.
