On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas Centralized Supply Chain Ontario (“Supply Ontario”) is a corporation without share capital established pursuant to Ontario Regulation 612/20 (Centralized Supply Chain Ontario) under the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019;

And whereas Supply Ontario is an agent of the Crown for all purposes;

And whereas the Lieutenant Governor in Council considers it reasonable and appropriate for Supply Ontario to participate in the Ontario Public Service group insured employee benefits program (the “OPS Program”), which may include life insurance benefits, supplementary health benefits (including vision care and health), dental and long term disability benefits;

And whereas the Crown is requesting that Supply Ontario indemnify the Crown against any and all liabilities arising out of, based upon, occasioned by or attributed to Supply Ontario’s participation as an employer under the OPS Program;

And whereas pursuant to paragraph 3 of subsection 4(3) of Ontario Regulation 612/20 under the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019, Supply Ontario requires the approval of the Lieutenant Governor in Council to indemnify any person from liability or guarantee the payment of money or the performance of services by another person;

And whereas it is considered desirable to authorize Supply Ontario to indemnify the Crown against liabilities arising out of, based upon, occasioned by or attributed to Supply Ontario’s participation as an employer under the OPS Program;

Now therefore pursuant to paragraph 3 of subsection 4(3) of Ontario Regulation 612/20 under the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019, approval is hereby given to Supply Ontario to indemnify the Crown against any and all liabilities arising out of, based upon, occasioned by or attributable to Supply Ontario’s participation as an employer under the OPS Program.
