On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas Hornepayne Lumber Limited Partnership, a limited partnership formed under the laws of Ontario, by its general partner Hornepayne Lumber GP Inc., a corporation existing under the laws of Ontario (the “Company”), desires to continue to operate a forest resource processing facility in Hornepayne, Ontario (the “Facility”);

And whereas the Olav Haavaldsrud Timber Company Limited, a corporation existing under the laws of the Ontario (“Haavaldsrud”) was a successful proponent in Stage II of the Province of Ontario’s Wood Supply Competitive Process and as a result was offered a conditional offer of Crown wood supply on March 3, 2011 (the “Offer”);

And whereas the Offer was transferred to the Company by way of an assignment, consent, and amendment agreement dated October 4, 2016;

And whereas as a result of the Company satisfying all of the conditions of the Offer, Her Majesty the Queen in Right of Ontario as represented by the Minister of Northern Development, Mines, Natural Resources and Forestry proposes to enter into an agreement with the Company for a supply of Crown forest resources to be made available for the Facility in accordance with sections 24 and 25 of the Crown Forest Sustainability Act, 1994, S.O. 1994, c. 25;

Now therefore, pursuant to subsection 25(1) of the Crown Forest Sustainability Act, 1994, S.O. 1994, c. 25, the Minister of Northern Development, Mines, Natural Resources and Forestry is hereby given approval to enter into the supply agreement numbered 536264 with the Company for a supply of Crown forest resources, being an annual target volume of 220,000 cubic metres, to be made available to the Company for use at the Facility.
