On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the mandate originally set out in the Bilingual Order in Council number O.C. 1264/2016 dated August 24, 2016, and pursuant to which the Honourable Marion R. Buller, Michèle Taïna Audette, E. Qajaq Robinson, Marilyn Poitras (since resigned) and Brian Eyolfson were appointed as commissioners under section 3 of the Public Inquiries Act, 2009, has been completed except for the reporting requirements thereunder and the winding up of the Commission;

Now therefore it is ordered that O.C. 1264/2016 be amended effective the date this Order in Council is approved and ordered by replacing paragraphs 1, 4 and 13 as follows:

  1. A commission is established (the “Commission”) and the Honourable Marion R. Buller,  Michèle Taïna Audette, E. Qajaq Robinson and Brian Eyolfson are appointed as commissioners under section 3 of the Public Inquiries Act (the “Commissioners”), effective as of September 1, 2016;
  1. The Commission shall collect and receive all information and records that it considers necessary to discharge its mandate and, for that purpose, may, before December 30, 2018:
    1. compel the attendance of any person to provide testimony under oath or affirmation or in any other manner that the Commission considers appropriate; and
    2. require the production of information that would otherwise be confidential or inadmissible under any statute or regulation.
  1. The Commission shall simultaneously deliver to the Governments of Canada and Ontario: 
    1. an interim report containing its preliminary findings, conclusions and recommendations (the “Interim Report”) before November 1, 2017; and
    2. a final report containing its findings, conclusions and recommendations (the “Final Report”) before April 30, 2019.
