Order in Council 169/2023

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas, Chad Michael Evans has been appointed as Chief Executive Officer of the Ontario Northland Transportation Commission,

Therefore, pursuant to subsection 21.1(3) of the Ontario Northland Transportation Commission Act, R.S.O. 1990, Chapter O.32, Chad Michael Evans is hereby entitled to the following as remuneration and benefits effective the date of this Order:

1. An annual salary of $ 290,000 per annum, less applicable deductions, for a term not exceeding one year.
2. Effective for the 2022-2023 performance year, eligibility for pay for performance (“pay at risk”) as per the structure set out in the Ontario Northland Transportation Commission Executive Compensation Program whereby a component of executive pay up to 8% is re-earnable and paid only where performance commitments are met and subject to any statutory requirements or limitations.
3. Eligibility for participation in all applicable benefits programs that the Ontario Northland Transportation Commission provides to its non-union employees, including enrolment in the Public Service Pension Plan, and including any additions or changes to those programs made during the term of the appointment.
4. Reimbursement for necessary expenses incurred in assuming and performing the duties of Chief Executive Officer, in accordance with all applicable Treasury Board and Management Board of Cabinet directives, guidelines and policies.
5. In the event of early termination for any reason other than for cause, entitlement to a severance payment subject to the requirements under the Broader Public Sector Executive Compensation Act, 2014.

Further, except as specified in this Order, Chad Michael Evans is not entitled to or eligible for any other payments whatsoever (p. ex., bonuses, merit increases, salary adjustments, incentive payments, or termination payments) from Ontario Northland Transportation Commission in respect of his appointment as Chief Executive Officer.

And further, this Order comes into effect on the Approved and Ordered date below.
