On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

whereas

  1. Cancer Care Ontario ("CCO") is a corporation without share capital continued under section 1 of the Cancer Act (the "Act").
  2. CCO is required under subsection 14(1) of the Act to obtain the approval of the Lieutenant Governor in Council ("LGIC") before acquiring lands and buildings whether by purchase or lease.

Current Leases

  1. CCO entered into leases for office space at the locations set out in Appendix 1 attached to this Order in Council, for the terms set out in Appendix 1 (the “Current Leases”).
  2. CCO entered into the Current Leases without obtaining the approval of the LGIC as CCO did not understand that section 14(1) of the Act applied to the acquisition of a leasehold interest and that LGIC approval was, therefore, required.

Proposed New Leases

  1. CCO is proposing to enter into leases for the office space at the locations set out in Appendix 2 for the terms set out in Appendix 2 (the “New Leases”).

Approval Sought

  1. CCO is seeking:
    1. the approval of the LGIC for the Current Leases; and
    2. the approval of the LGIC to enter into the New Leases.

now therefore, pursuant to subsection 14(1) of the Act, the LGIC provides to CCO:

  1. approval to enter into the Current Leases; and
  2. approval to enter into the New Leases.
