On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Pursuant to Section 6.0.1 of the Public Service Pension Act, 1990, the Public Service Past Service Supplemental Pension Plan (Plan) is established effective December 18, 2020 (the terms and conditions of which are set out in the annexed schedule) as follows:

  • The Plan is being established for the purposes of allowing Plan members to fund past service pension benefits that cannot be provided under the Public Service Supplementary Benefits Account (the “PSSBA”);
  • In the event that the PSSBA becomes funded, either partly or fully, through a Retirement Compensation Arrangement as that term is defined under the federal Income Tax Act (Canada) and Regulations, then the Plan shall be terminated and any funds under the Plan shall be transferred to the PSSBA and Plan benefits shall be payable from the PSSBA; and
  • The Ontario Public Service Pension Board may enter into an agreement with the Crown to administer the Plan.
