Order in Council 1838/2016

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

whereas the Government of Ontario has established an Aboriginal Justice Advisory Group to provide advice to the Attorney General and other members of the Executive Council as appropriate arising from the First Nations Representation on Ontario Juries Report released February 26, 2013, and to provide such other assistance as may be required by the Attorney General;

and whereas the Government of Ontario wishes to ensure that the Aboriginal Justice Advisory Group members are remunerated for their time during the extension period beginning on December 4, 2016 and expiring on December 3, 2017;

therefore, pursuant to the prerogative of Her Majesty the Queen in Right of Ontario to provide for the remuneration of advisors who serve Her Majesty’s Government of Ontario in the discharge of its executive obligations and responsibilities:

1. Members of the Aboriginal Justice Advisory Group (the “Advisory Group”), other than a chair or co-chair, who are not employed by the Government of Ontario shall be compensated at the rate of $200 per diem to a maximum of twenty-four days in a fiscal year;
2. A chair or co-chair who is not employed by the Government of Ontario shall be compensated at the rate of $350 per diem to a maximum of thirty-two days in a fiscal year;
3. All members of the Advisory Group shall be reimbursed for reasonable expenses incurred while engaged in the business of the Advisory Group in accordance with the relevant directives, guidelines and policies of the Treasury Board and Management Board of Cabinet; and
4. Despite paragraphs 1, 2 and 3, any member who is a judicial officer is not entitled to per diem remuneration but shall be reimbursed for reasonable expenses in accordance with the expense-related directives, guidelines and policies applicable to the judicial office that the member holds.
