Order in Council 1839/2016

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

whereas an agreement effective December 17^th, 2015 was entered into between the Deputy Minister of Finance and Green Shields Benefits Association under which $3,365,000 was transferred to Green Shield Benefits Association for the purpose of establishing a fund (“Fund”) to provide the retirees and their spouses and dependants with transitional support in respect of suspended benefits;

and whereas subparagraph 1(a) of Order in Council 1854/2015 was amended on June 8 2016 by Order in Council 921/2016 to strike out “not to exceed $3.4 million” and substitute “not to exceed $6.4 million”;

and whereas three amending agreements effective March 16th 2016, July 19th 2016 and November15th2016 respectively were entered into between the Deputy Minister of Finance and Green Shield Benefits Association under which changes were made to the structure of the Fund and the additional amounts were transferred to Green Shield Benefits Association to continue to provide the retirees and their spouses and dependants with transitional support in respect of suspended benefits;

and whereas it is expected that the additional funding made available pursuant to Order in Council 921/2016 will be depleted by the end of December 2016;

and whereas it is considered desirable to make additional funding available to the fund;

therefore, pursuant to the Royal Prerogative:

1. Each of the Minister of Finance and the Deputy Minister of Finance (each an “authorized officer”) are hereby authorized, on behalf of Her Majesty the Queen in right of Ontario,

   all upon such other terms and conditions as the authorized officer may determine.

   1. to enter into one or more agreements with Green Shield Benefits Association to pay an amount not exceed $2.2 million to Green Shield Benefits Association; and
   2. to enter into and execute such other agreements, arrangements or documents as such authorized officer may consider necessary or desirable in connection with the agreement or agreements referred to in paragraph (a),

all upon such other terms and conditions as the authorized officer may determine.
