On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Crown maintains Ontario Health as an agent of the Crown pursuant to the Connecting Care Act, 2019;

And whereas effective on December 2, 2019 Ontario Health shall be an employer under the Public Service Pension Plan (PSPP) set out in Schedule 1 to the Public Service Pension Act, 1989, as amended, for the purpose of the employees designated in this Order;

And whereas members of the PSPP whose pension benefits under the PSPP exceed the maximum pension benefits permitted under the Income Tax Act (Canada) in respect of registered pension plans also participate in the Public Service Supplementary Benefits Account (PSSBA) that has been continued under Order in Council O.C. 867/2019, and as may be further amended from time to time;

And whereas it is reasonable and appropriate for former employees of legacy Ministry of Health agencies who were members of the Healthcare of Ontario Pension Plan (HOOPP) as at the date of transfer into Ontario Health to remain as members of that pension plan;

And whereas it is reasonable and appropriate for former employees of legacy Ministry of Health agencies who were members of the PSPP as at the date of transfer into Ontario Health to remain as members of that pension plan;

And whereas employees who were members of the PSPP were transferred on December 2, 2019 from HealthForceOntario Marketing and Recruitment Agency and Ontario Health Quality Council to Ontario Health and remain members of the PSPP after the transfer;

And whereas employees who were members of the eHealth Ontario defined contribution pension plan were transferred on December 2, 2019 from eHealth Ontario to Ontario Health and will remain members of the eHealth Ontario defined contribution pension plan up to and including December 31, 2021;

And whereas employees who were members of HOOPP were transferred on December 2, 2019 from Cancer Care Ontario, and Health Shared Services Ontario to Ontario Health and remain members of HOOPP;

And whereas employees who were members of HOOPP were transferred on April 1, 2020 from Ontario Telemedicine Network to Ontario Health and remain members of HOOPP;

And whereas employees who were members of HOOPP were transferred on April 1, 2021 from specific functions in the 14 Local Health Integration Networks and Trillium Gift of Life Network to Ontario Health and remain members of HOOPP;

And whereas employees who are members of HOOPP will be transferred on December 1, 2021 from CorHealth Ontario to Ontario Health and will remain members of HOOPP;

And whereas the employees of any additional organizations as defined under section 40 (2) (8) of the Connecting Care Act, 2019 that are merged with, or transferred at a future date to, Ontario Health will be required to participate in the PSPP as of the date of transfer, unless an alternative transition arrangement is agreed to by the organization, Ontario Health and Treasury Board Secretariat;

And whereas it is Ontario’s objective to migrate legacy Ministry of Health agencies towards a common pension plan, namely, the PSPP. Ontario Health, Ministry of Health and the Treasury Board Secretariat have agreed upon a transition period ending on December 31, 2024 as follows:

  1. Employees hired by Ontario Health on December 2, 2019 and up to and including December 31, 2021 who are members of HOOPP immediately preceding their Ontario Health hire date will continue membership in HOOPP.
  2. Employees hired by Ontario Health on January 1, 2022 and up to and including December 31, 2024 who are members of HOOPP immediately preceding their Ontario Health hire date, and who have five or more years of continuous service as members under HOOPP will continue membership in HOOPP.
  3. Ontario Health employees:
    1. to whom neither paragraph 1. nor paragraph 2. immediately above apply; and/or
    2. who are hired by Ontario Health on and after January 1, 2025

    will be required to participate in the PSPP.

Now therefore, pursuant to:

  1. paragraph 2 of subsection 2(1) of the PSPP, all permanent full-time and permanent part-time employees of Ontario Health who are:
    1. hired by Ontario Health on or after December 2, 2019, or
    2. former employees of HealthForceOntario Marketing and Recruitment Agency, or
    3. former employees of Ontario Health Quality Council

    are designated as a class of employees who are required to become members of the PSPP in respect of service with Ontario Health on and after December 2, 2019; and

  2. paragraph 1 of subsection 2(2) of the PSPP, all fixed-term full-time and fixed-term part-time employees of Ontario Health who are:
    1. hired by Ontario Health on or after December 2, 2019, or
    2. former employees of HealthForceOntario Marketing and Recruitment Agency, or
    3. former employees of Ontario Health Quality Council

    are designated as a class of employees who are entitled to become members of the PSPP in respect of service with Ontario Health on and after December 2, 2019 upon filing a written election with the Ontario Pension Board (OPB); and

  3. paragraph 2 of subsection 2(1) of the PSPP, all permanent full-time and permanent part-time employees of Ontario Health who are former employees of eHealth and members of the eHealth defined contribution pension plan for the period up to and including December 31, 2021 are designated as a class of employees who are required to become members of the PSPP in respect of service with Ontario Health on and after January 1, 2022; and
  4. paragraph 1 of subsection 2(2) of the PSPP, all fixed-term full-time and fixed-term part-time employees of Ontario Health who are former employees of eHealth are designated as a class of employees who are entitled to become members of the PSPP in respect of service with Ontario Health on and after January 1, 2022 upon filing a written election with OPB.
  5. Notwithstanding paragraphs 1, 2, 3 and 4 immediately above, Ontario Health bargaining-represented employees whose collective agreement stipulates membership in a particular pension plan will continue to participate in the specified pension plan. If such bargaining-represented employee moves to an Ontario Health non-bargaining position prior to January 1, 2025, then the employee will continue to be a member of the pension plan that they are currently participating in. Notwithstanding the immediately preceding sentence, any such job change made on or after January 1, 2025 will require the employee to become a member of the PSPP as at the effective date of their job change.
  6. Notwithstanding paragraphs 1, 2, 3 and 4 immediately above, if an Ontario Health non-bargaining represented employee moves to an Ontario Health bargaining-represented position, the employee will be required to become a member of the pension plan specified in the collective agreement.
  7. Notwithstanding paragraphs 1 and 2 but subject to paragraphs 5 and 6 immediately above, Ontario Health employees hired on or after December 2, 2019 and before January 1, 2022, will remain in the pension plan that they are participating in since their date of hire.
  8. Notwithstanding paragraphs 1 and 2 but subject to paragraphs 5 and 6 immediately above, Ontario Health employees hired on or after January 1, 2022 and before January 1, 2025 who have five or more years of continuous service as members under HOOPP will continue to be members of HOOPP.
