On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Ontario Pension Board provides services to the Provincial Judges Pension Board for the administration of the Provincial Judges Pension Plan as set out in O. Reg. 290/13 made under the Courts of Justice Act, R.S.O. 1990, Chapter C.43 (“PJPP”);

And whereas the funding structure of the PJPP is being revised in a manner that establishes trust agreements for a registered pension plan and retirement compensation arrangement in respect of the PJPP (“PJPP Trust Agreements”);

And whereas the Ontario Pension Board has been jointly selected by the Crown and the Provincial Judges Pension Board to be the service provider under the PJPP Trust Agreements;

And whereas the Crown will also seek the advice and expertise of the Ontario Pension Board regarding the investment of funds whose interest rate will be used to set the interest rate for the portion of the PJPP that is maintained as a special purpose account in the Consolidated Revenue Fund;

And whereas the Lieutenant Governor in Council wishes to amend the powers of the Ontario Pension Board, as constituted under the Public Service Pension Plan, to clearly authorize the Ontario Pension Board to carry out the role of service provider under the PJPP Trust Agreements and to provide the Crown with certain investment advice;

Now therefore, pursuant to subsection 6 (1) of the Public Service Pension Act, R.S.O. 1990, c.P.48, the PSPP set out in Schedule 1 under that Act, as amended, is further amended as follows:

  1. Section 32 of the Plan is amended by adding the following as subsection(s):
    1. Enter into an agreement to provide administration services in respect of the Provincial Judges Pension Plan as set out in O. Reg. 290/13 made under the Courts of Justice Act and to carry out any powers delegated to the Board pursuant to the trust agreements established with respect to that plan.
    2. Enter into an agreement to provide advisory and other services related to the investment of funds whose interest rate may be used to set the interest rate for one or more accounts that are maintained in the Consolidated Revenue Fund of the Government of Ontario.
    3. The costs associated with the services provided under subsections (i) and (j) shall not be payable from the Fund.
