On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

whereas subsection 17(1) of Ontario Regulation 58/16 (Collection of Identifying Information in Certain Circumstances – Prohibition and Duties) made under the Police Services Act (“the Regulation”) requires the Minister of Community Safety and Correctional Services (“Minister”) to ensure that a review of the Regulation is conducted and that a report on the findings of the review is published no later than January 1, 2019;

and whereas subsection 17(2) of the Regulation requires the Minister to ensure that the person who conducts the review is not a public servant within the meaning of the Public Services of Ontario Act, 2006, and is not employed in the office of the Premier or in the office of a minister;

and whereas the Government of Ontario and the Minister wish to establish a position, and thereafter appoint an individual, to conduct the independent review required under the Regulation;

therefore pursuant to the prerogative of Her Majesty the Queen in Right of Ontario to appoint special advisors to serve Her Majesty’s Government of Ontario in the discharge of its executive obligations and responsibilities:

  1. Special Advisor Established

    The position of Independent Reviewer of Ontario Regulation 58/16 (“Independent Reviewer”), accountable to the Minister, is hereby established.

  2. Terms of Reference

    The Minister shall determine the terms of reference of the Independent Reviewer and may amend them from time to time.

  3. Term of Appointment

    The Independent Reviewer shall be appointed to serve at the pleasure of the Lieutenant Governor in Council for a period not exceeding three years from the date of appointment.

  4. Remuneration and Expenses

    The Independent Reviewer shall be paid such remuneration and shall be reimbursed for such expenses as the Lieutenant Governor in Council may determine.
