Order in Council 2103/2017

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Case Management Masters Remuneration Commission (“Commission”) has been established under Order in Council O.C. 359/2012 (Commission Order);

And Whereas the Masters Association of Ontario, which represents the Case Management Masters, and the President of the Treasury Board have jointly agreed that the Commissioner should sit simultaneously for the Second and Third Commission and make judicial remuneration recommendations for a period starting on April 1, 2016 and ending on March 31, 2020 in respect of the Second Commission and for a period starting on April 1, 2020 and ending on March 31, 2024 in respect of the Third Commission;

And Whereas Mr. William Kaplan has been appointed as Commissioner of the Second and Third Commission for a period beginning on October 1, 2015 and ending on September 30, 2019 in respect of the Second Commission and for a period beginning on October 1, 2019 and ending on September 30, 2023 in respect of the Third Commission;

And Whereas Mr. Kaplan is being remunerated for work carried out as Commissioner of the Second Commission pursuant to Order in Council O.C. 1266/2017;

Now therefore pursuant to subsection 4(9) of the Order, Mr. Kaplan shall be paid at a rate of $290 per hour to a maximum of $2,900 per day for work carried out as Commissioner of the Third Commission;

And further, Mr. Kaplan shall be reimbursed for reasonable expenses incurred in carrying out the duties of the Commissioner of the Third Commission in accordance with the relevant directives, guidelines and policies of the Treasury Board and Management Board of Cabinet.
