Order in Council 220/2022

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas pursuant to section 7 of the Crown Forest Sustainability Act, 1994, S.O. 1994, c. 25, the then Minister of Natural Resources designated a management unit for the purposes of the Crown Forest Sustainability Act, 1994 (the “Temagami Management Unit”), and such designation became effective April 1, 1996;

And whereas pursuant to section 26 of the Crown Forest Sustainability Act, 1994, the Minister of Northern Development, Mines, Natural Resources and Forestry (the “Minister”) may, with the approval of the Lieutenant Governor in Council, grant a renewable licence to harvest forest resources in a management unit for a term of up to 20 years, which licence requires the licensee to carry out renewal and maintenance activities for the benefit and on behalf of the Crown necessary to provide for the sustainability of the Crown forest in the area covered by the licence (“SFL”);

And whereas Temagami Forest Management Corporation (“TFMC”), a Crown agency, was established as a corporation without share capital on December 15, 2020 by a regulation under the Ontario Forest Tenure Modernization Act, 2011 and pursuant to section 5 of the Ontario Forest Tenure Modernization Act, 2011 one of TFMC’s objects is to hold forest resource licences and manage Crown forests in a manner necessary to provide for the sustainability of Crown forests in accordance with the Crown Forest Sustainability Act, 1994 and to promote the sustainability of Crown forests;

And whereas TFMC wants to carry out its objects and the Minister wants to grant to TFMC an SFL covering the Temagami Management Unit;

Now therefore, pursuant to subsection 26(1) of the Crown Forest Sustainability Act, 1994, the Minister is hereby given approval to grant an SFL substantially in the form of SFL 554687 to TFMC.
