Order in Council 244/2017

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Lieutenant Governor by Orders-in-Council made under section 2 of the Public Lands Act, listed in the Schedule, transferred administration and control of certain public lands (the “Lands”) for a specified purpose to the Minister of Environment or the Minister’s successor or the Ontario Water Resources Commission;

And whereas the Orders-in Council listed in the Schedule contain conditions that require the administration and control of the Lands to revert back to the Minister of Natural Resources when the Lands are no longer required for the purpose for which they were transferred;

And whereas the Municipal Water and Sewage Transfer Act, 1997 authorized the Minister of the Environment to transfer by order Crown-owned water and wastewater facilities and interests in land associated therewith to municipalities (“Transfer Order”);

And whereas some Transfer Orders conveyed interests in the Lands;

And whereas the Minister of Natural Resources and Forestry does not require the Lands to revert to her administration and control in the future and supports the request from the Minister of the Environment and Climate Change to pursue an amendment to the Orders-in-Council listed in the Schedule to remove any conditions in respect of the administration and control reverting to the Minister of Natural Resources and Forestry.

Therefore for each item in the attached Schedule, the Order in Council set out in Column 1, approved and ordered as of the date specified in Column 2, in respect of the lands more particularly described in Column 3, is hereby amended in the manner described in Column 4, pursuant to subsection 2(1) of the Public Lands Act, R.S.O 1990, chapter P.43.
