On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Government of Ontario is committed to fostering an energy future that is innovative, efficient, and accessible for Ontarians;

And Whereas the Government of Ontario recognizes that the Ontario Energy Board (“OEB”), the energy sector’s independent regulator, will play a critical role with respect to this commitment, and that in light of recent trends in the energy sector (including the emergence of disruptive technologies, changing consumer expectations, and challenges to traditional utility business models), it will be important to assess the ability of the Ontario energy regulatory framework in supporting this commitment;

And Whereas the Government of Ontario accordingly wishes to establish an expert panel to support a modernization review of the OEB and provide advice and recommendations to the Minister of Energy (the “Minister”) in this regard;

Therefore, pursuant to subparagraph 12(1)(a) of the Ministry of Energy Act, 2011, the Ontario Energy Board (OEB) Modernization Review Panel (the “Panel”) is hereby established as a short-term advisory body as of the date of this Order and as follows,

Panel established for two years

  1. The Panel is hereby established as a short-term advisory body, accountable to the Minister, for a period of two (2) years from the date of this Order.

Terms of reference

  1. The Minister shall determine the terms of reference for the Panel, and may amend them from time to time.

Appointments to the Panel

  1. The Panel shall be comprised of three (3) members to be appointed by the Minister, and the Minister shall designate one (1) member as Chair.
  2. The members of the Panel, including the Chair, shall serve at the Minister’s pleasure for a period not exceeding two (2) years from the date of this Order.

Remuneration

  1. The members of the Panel, including the Chair, shall be paid such remuneration and expenses as the Lieutenant Governor in Council may determine.
