Order in Council 247/2018

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Pursuant to subsection 6(2) of the Ministry of Natural Resources Act and subsection 76(2) of the Legislation Act, 2006, persons appointed as a part-time member of the Mining and Lands Tribunal be paid a per diem of $463 during the term of their appointment.

Further, in the event that any part-time appointees are cross-appointed to more than one adjudicative tribunal or regulatory agency, the following restrictions apply:

1. appointees who hold more than one part-time appointment are entitled to the remuneration associated with each appointment, provided that only one per diem is paid in respect of a calendar day;
2. appointees who also hold a full-time appointment are entitled to the remuneration associated with their full-time appointment only.

And further, part-time appointees shall be reimbursed for reasonable expenses incurred in carrying out their duties in accordance with the relevant directives, guidelines and policies of the Treasury Board and Management Board of Cabinet, all of which is effective the day section 3 of Schedule 17 to the Stronger, Healthier Ontario Act (Budget Measures), 2017 comes into force.
