On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Government of Ontario has committed to launching a review of the Workplace Safety and Insurance Board (“WSIB”) to ensure it remains sustainable in the future;

And whereas the Government of Ontario wants such a review (the “WSIB Operational Review”) to be conducted by outside experts, namely, two special advisors.  One special advisor shall be an Insurance Expert; the other special advisor shall be a Governance Expert.

Therefore, pursuant to the prerogative of Her Majesty the Queen in Right of Ontario to provide for the appointment of advisors to serve Her Majesty’s Government of Ontario in the discharge of its executive obligations and responsibilities,

  1. The Insurance Expert special advisor position and the Governance Expert special advisor position (the “Special Advisors”) are established for the term of the WSIB Operational Review, which will be from the date this Order in Council is made to August 26, 2019, inclusive.
  2. The WSIB Operational Review shall focus on three themes, namely,
    1. financial oversight of the WSIB, including controls, validation of the premium rate framework, and sustainability of the WSIB’s insurance fund;
    2. administrative effectiveness of the WSIB’s current government and executive management structure; and
    3. cost-efficiency and effectiveness of the WSIB’s operations, including comparisons with other jurisdictions and with private-sector insurers.
  3. The Special Advisors shall be appointed by the Lieutenant Governor in Council and are accountable to the Minister.
  4. The Special Advisors shall perform their review in accordance with a Terms of Reference to be issued by the Minister in accordance with the focus described in section 3, above. The Terms of Reference may be amended from time to time by the Minister.
  5. The Special Advisors shall be paid such remuneration as the Lieutenant Governor in Council may determine.
