Order in Council 302/2018

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas pursuant to section 7 of the Crown Forest Sustainability Act, 1994, S.O. 1994, c. 25 (“CFSA”), the then Minister of Natural Resources designated the management unit currently known as the Lac Seul Forest (the “Lac Seul Forest Management Unit”) effective as of April 1, 2001;

And Whereas pursuant to section 26 of the CFSA, the Minister of Natural Resources and Forestry (the “Minister”) may, with the approval of the Lieutenant Governor in Council, grant a renewable licence to harvest forest resources in a management unit for a term of up to 20 years, which requires the licensee to carry out renewal and maintenance activities for the benefit and on behalf of the Crown necessary to provide for the sustainability of the Crown forest in the area covered by the licence (an “SFL”);

And Whereas Obishikokaang Resources Corporation (“ORC”) currently manages the Lac Seul Forest Management Unit under Forest Resource Licence No. 553611 granted pursuant to section 27 of the CFSA that came into effect on April 1, 2017 and expires on March 31, 2018 (the “FRL”);

And Whereas Ondaadiziwin Forest Management Inc. (“OFMI”) was established as a corporation without share capital on November 28, 2016 and one of OFMI’s objects is to hold forest resource licences and manage Crown forests, specifically the Lac Seul Forest, in a manner necessary to provide for the sustainability of Crown forests in accordance with the CFSA and to promote the sustainability of Crown forests;

And Whereas OFMI wants to carry out its objects and the Minister wants to grant to OFMI an SFL covering the Lac Seul Forest Management Unit for a term of up to 20 years;

Therefore, pursuant to subsection 26(1) of the CFSA, the Minister is hereby given approval to grant to OFMI an SFL substantially in the form of SFL 553776 for a term of up to 20 years, expiring on March 31, 2038, covering the Lac Seul Forest Management Unit.
