Order in Council 338/2017

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Ministry of Community Safety and Correctional Services is committed to reviewing and considering the public comments received regarding proposed changes to the Provincial Nuclear Emergency Response Plan Master Plan and its Planning Basis;

And Whereas it has been determined that it is desirable to establish an advisory group of experts in the areas of emergency management, nuclear and radiation safety and nuclear emergency response, to provide advice to the Minister of Community Safety and Correctional Services (“Minister”) regarding the incorporation of these public comments in updating the Provincial Nuclear Emergency Response Plan Master Plan;

Therefore pursuant to the prerogative of Her Majesty the Queen in right of Ontario to establish a Short Term Advisory Body to assist Her Majesty’s Government of Ontario in the discharge of its executive obligations and responsibilities:

Establishment of the Advisory Group

1. The Provincial Nuclear Emergency Response Plan Advisory Group (“Advisory Group”) is established effective the date of this Order in Council and it will continue to exist until it provides the Minister with its final report or until December 29, 2017, whichever comes first.

Terms of Reference for the Advisory Group

2. The terms of reference for the Advisory Group are those that have been set out by the Minister in the document entitled Terms of Reference for the Provincial Nuclear Emergency Response Plan Advisory Group and dated January 4, 2017, and as they may be amended by the Minister from time to time.

Appointments to the Advisory Group

3. The Minister shall appoint up to six (6) members to the Advisory Group and the Minister shall designate one member as the Chair.
4. The Minister can revoke the appointment of any member of the Advisory Group at the Minister’s sole discretion.

Remuneration of the Members of the Advisory Group

5. Members of the Advisory Group shall be paid such remuneration and shall be reimbursed for such expenses as the Lieutenant Governor in Council may determine.

Governance of the Advisory Group

6. The Advisory Group is subject to the applicable laws of Ontario; the Management Board of Cabinet’s Agencies & Appointments Directive, 2016 and any successor thereto, and to all other applicable government directives, policies and guidelines.
