Order in Council 342/2017

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas Her Majesty the Queen in Right of Ontario as represented by the Minister of Infrastructure is the owner of certain lands located in Niagara Falls, Ontario and described in Schedule “A” (the “Lands”);

And Whereas pursuant to section 11 of the Ministry of Infrastructure Act, 2011, S.O. 2011, c.9, Sched. 11, as amended (the “MOI Act”), the Lands are under the control of the Minister of Infrastructure;

And Whereas the Lands comprise a portion of the Niagara Parkway and pursuant to the Niagara Parks Act, R.S.O. 1990, c. N.3, as amended (the “NPA”), it is the duty of The Niagara Parks Commission (the “Commission”) to manage and control the Parks including the Niagara River Parkways;

And Whereas the Minister of Infrastructure has ordered the transfer of administration and control of the Lands to the Commission by way of order pursuant to section 11.1 of the MOI Act, subject to approval therefor by this Order in Council;

Now Therefore pursuant to section 7 of the Niagara Parks Act, R.S.O. 1990, c. N.3, as amended, approval is hereby given to The Niagara Parks Commission:

1. to acquire administration and control of the Lands; and
2. to execute such documents as may be necessary for that purpose.
