On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Government of Ontario has an interest in obtaining independent progress reports with respect to compliance with the 2013 Jahn settlement and the terms of the order entered as a consent order with the Human Rights Tribunal of Ontario and dated January 16, 2018 (the “Order”);

And whereas the Government of Ontario wishes to establish a position and appoint an individual for the purpose of obtaining independent progress reports with respect to compliance with the 2013 Jahn settlement and the terms of the Order;

Therefore, pursuant to the prerogative of Her Majesty The Queen in Right of Ontario to appoint advisors to serve Her Majesty’s Government of Ontario in the discharge of its executive obligations and responsibilities:

  1. Independent Reviewer
    The position of Independent Reviewer (“Independent Reviewer”), as set out in section 12 of Schedule “A” Public Interest Remedies Relating to Human Rights and Segregation to the Order, is hereby established and is accountable to the Minister of Community Safety and Correctional Services (the “Minister”).
  2. Terms of Reference
    The Independent Reviewer will report on compliance with the 2013 Jahn settlement and the terms of the Order in accordance with Schedule “A” Public Interest Remedies Relating to Human Rights and Segregation to the Order. The Minister shall determine the terms of reference of the Independent Reviewer and may amend them from time to time.
  3. Term of Appointment
    The Independent Reviewer shall be appointed to serve at the pleasure of the Lieutenant Governor in Council for a period not exceeding two years from the date of the appointment.
  4. Remuneration and Expenses
    The Independent Reviewer shall be paid such remuneration and shall be reimbursed for such expenses as the Lieutenant Governor in Council may determine.
