Order in Council 370/2018

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas Jerry DeMarco was appointed full-time Executive Chair of Environment and Land Tribunals Ontario on an interim basis by Order in Council 347/2018 dated February 28, 2018;

Therefore, pursuant to subsection 76(2) of the Legislation Act, 2006 and subsection 16(1) of the Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009,

Jerry DeMarco be paid an annual remuneration of $208,601 during the term of his appointment.

Further, this remuneration rate shall be revised, effective January 1, 2018, by a percentage amount equal to the public sector wage settlement trend in Ontario as reported in the Ontario Budget papers for the 2018-2019 fiscal year that are laid before the Assembly referencing the date that precedes but is closest to January 1, 2018, if positive, in respect of this appointment.

Further, Jerry DeMarco shall be eligible for benefits, including vacation, comparable to the benefit entitlements of OPS executives in the Senior Management Group.

Further, Jerry DeMarco may elect to participate in the Public Service Pension Plan in accordance with the provisions of the Plan.

And further, Jerry DeMarco shall be reimbursed for reasonable work-related expenses while engaged in the business of Executive Chair of Environment and Land Tribunals in accordance with the Travel, Meal and Hospitality Expenses Directive and any other Treasury Board and Management Board of Cabinet directives.
