Order in Council 392/2023

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Niagara Parks Commission (the “Commission”) is the owner of the lands identified in Schedule A (the “Lands”);

And whereas, pursuant to an Encroachment Agreement dated November 6, 2020, the Commission agreed to sell the Lands to 2702625 Ontario Inc., subject to receipt of approval from the Lieutenant Governor in Council;

Now therefore, pursuant to section 7 of the Niagara Parks Act, R.S.O. 1990, c. N.3., as amended, approval is hereby given to the Commission to:

1. sell the Lands to 2702625 Ontario Inc.; and
2. execute such documents as may be necessary for that purpose.
