Order in Council 617/2021

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Ontario Cannabis Retail Corporation (the Corporation) is an agent of the Crown established under the Ontario Cannabis Retail Corporation Act, 2017 as a corporation without share capital;

And whereas the Lieutenant Governor in Council, under OIC 464/2018, approved the designation of the Corporation as a participating employer in the Public Service Pension Plan set out in Schedule 1, as amended, to the Public Service Pension Act, 1989 (PSPP) and in the Public Service Supplementary Benefits Account continued under Order in Council 867/2019, as may be amended from time to time (PSSBA) such that eligible employees of the Corporation may participate in the PSPP and the PSSBA;

And whereas there is a desire to clarify that employees of the Corporation who are represented by the Ontario Public Service Employees Union (OPSEU) are not eligible to participate in the PSPP and the PSSBA;

And whereas employees of the Corporation who are represented by OPSEU are instead eligible to participate in the Ontario Public Service Employees’ Union Pension Plan;

Now therefore pursuant to paragraph 2 of subsection 2(1) of the PSPP, it is hereby clarified that effective January 1, 2018, all permanent full-time employees of the Corporation who are not represented by the Ontario Public Service Employees Union are designated as a class of employees who are required to become members of the PSPP;

And pursuant to subsection 2(2) of the PSPP, it is hereby clarified that effective January 1, 2018, all permanent/fixed-term part-time employees and all fixed-term full-time employees of the Corporation who are not represented by the Ontario Public Service Employees Union are designated as a class of employees who are entitled but not required to become members of the PSPP and shall, upon filing a written election with the Ontario Pension Board, become members of the PSPP.
