Order in Council 788/2020

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Federal Minister of Finance gave notice of the proposed Calculation of Contribution Rates Regulations, 2018 in the Canada Gazette, Part I, Volume 152, Number 42 on October 20, 2018;

And whereas if the Calculation of Contribution Rates Regulations, 2018 come into force, they will be made under subsection 115(1.3) of the Canada Pension Plan (R.S.C., 1985, c. C-8) and prescribe the manner of the calculation referred to in paragraphs 115(1.1)(c) to (e) of the Canada Pension Plan;

And whereas subsection 115(1.3) of the Canada Pension Plan states that subsection 114(4) of that Act applies, with any modifications that the circumstances require, to the making of the regulations prescribing the manner of the calculation referred to in paragraphs 115(1.1)(c) to (e) of that Act and to the making of any regulation changing that manner of calculation;

And whereas subsection 114(4) of the Canada Pension Plan provides that where any enactment of Parliament contains any provision that alters, or the effect of which is to alter, either directly or indirectly and either immediately or in the future, matters referred to in that subsection, it shall be deemed to be a term of that enactment, whether or not it is expressly stated in the enactment, that the provisions shall come into force only on a day to be fixed by order of the Governor in Council, which order may not be made and shall not in any case have any force or effect unless the lieutenant governor in council of each of at least two thirds of the included provinces, having in the aggregate not less than two thirds of the population of all of the included provinces, has signified the consent of that province to the enactment;

Therefore, in accordance with subsection 114(4) of the Canada Pension Plan (R.S.C., 1985, c. C-8) as modified by subsection 115(1.3), the Province of Ontario consents to the making of the Calculation of Contribution Rates Regulations, 2018 as published in the Canada Gazette, Part I, Volume 152, Number 42 on October 20, 2018.
