On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Pursuant to section 34 of the Public Vehicles Act, R.S.O. 1990, chapter P.54, the policy statement in Schedule A attached hereto is hereby issued. The policy statement in Schedule A shall apply to hearings or reviews conducted by the Ontario Highway Transport Board after this Order is published in The Ontario Gazette.

The Order in Council numbered O.C. 1200/97, dated June 4, 1997, is hereby revoked.

Policy Statement

When determining questions of public necessity and convenience under the Public Vehicles Act, R.S.O. 1990, c. P.54, as amended, the Ontario Highway Transport Board shall consider, together with such other matters as the Board considers appropriate, that the Province may establish programs to increase available transportation options, including intercommunity transportation options. Under such programs, the Province may provide grants to municipalities, First Nations communities, Métis communities, Indigenous organizations and not-for-profit organizations. Grant recipients are typically expected to provide services directly or by contract with a third party service provider, such as a private bus carrier. When deciding the question of public necessity and convenience, it is important to consider that such grants have been provided in order to address specific transportation needs identified by the Province.
