Order in Council 800/2018

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Ontario French-language Educational Communications Authority is a corporation without share capital continued under the name Ontario French-language Educational Communications Authority in English and Office des télécommunications éducatives de langue française de l’Ontario in French (“the Authority”) under subsection 2(1) of the Ontario French-language Educational Communications Authority Act, 2008;

And Whereas pursuant to subsection 6(5) of the Ontario French-language Educational Communications Authority Act, 2008, the Authority may, subject to the approval of the Lieutenant Governor in Council, acquire by purchase, lease or otherwise any land or interest in land;

And Whereas the Board of Directors of the Authority has approved an Offer to Lease from, Collège d’Arts Appliqués et de Technologie La Cité Collégiale, the Landlord, for approximately 4,858 square feet of office space at 801 promenade de l’Aviation, Ottawa, ON K1K 4R3 for a term of ten (10) years commencing on August 1, 2018 and expiring on July 31, 2028, which includes the Option to Extend the Lease for two (2) further terms of five (5) years on the same terms and conditions but at Fair Market Rent as determined by the parties;

And Whereas the Board of Directors of the Authority has approved monthly rental payments of eight thousand, seven hundred and forty four dollars and forty cents ($8,744.40), plus applicable taxes, on the first day of each month commencing with August of 2018 and ending in July of 2020;

And Whereas the Board of Directors of the Authority has approved monthly rental payments of nine thousand, seven hundred and fifty-six dollars and forty-eight cents ($ 9,756.48), plus applicable taxes, on the first day of each month commencing with August of 2020 and ending in July of 2022;

And Whereas the Board of Directors of the Authority has approved monthly rental payments of ten thousand, five hundred and eighty-six dollars and thirty-nine cents ($10,586.39), plus applicable taxes, on the first day of each month commencing with August of 2022 and ending in July of 2024;

And Whereas the Board of Directors of the Authority has approved monthly rental payments of eleven thousand, three hundred and ninety-six dollars and six cents ($11,396.06), plus applicable taxes, on the first day of each month commencing with August of 2024 and ending in July of 2026;

And Whereas the Board of Directors of the Authority has approved monthly rental payments of twelve thousand, two hundred and five dollars and seventy-three cents ($12,205.73), plus applicable taxes, on the first day of each month commencing with August of 2026 and ending in July of 2028;

Now therefore pursuant to subsection 6(5) of the Ontario French-language Educational Communications Authority Act, 2008, the Authority be authorised:

1. to enter into a Lease with the Landlord for 4,858 square feet of office space at the premises for a period of ten (10) years commencing on August 1, 2018 and terminating July 31, 2028, at the following monthly rental rates:
   1. eight thousand, seven hundred and forty four dollars and forty cents ($8,744.40), plus applicable taxes, on the first day of each month commencing with August of 2018 and ending in July of 2020;
   2. nine thousand, seven hundred and fifty-six dollars and forty-eight cents ($ 9,756.48), plus applicable taxes, on the first day of each month commencing with August of 2020 and ending in July of 2022;
   3. ten thousand, five hundred and eighty-six dollars and thirty-nine cents ($10,586.39), plus applicable taxes, on the first day of each month commencing with August of 2022 and ending in July of 2024;
   4. eleven thousand, three hundred and ninety-six dollars and six cents ($11,396.06), plus applicable taxes, on the first day of each month commencing with August of 2024 and ending in July of 2026; and,
   5. twelve thousand, two hundred and five dollars and seventy-three cents ($12,205.73), plus applicable taxes, on the first day of each month commencing with August of 2026 and ending in July of 2028.
2. to execute such documents as may be necessary for the purpose of entering into the Lease.
