Order in Council 935/2017

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas The Niagara Parks Commission (the “Commission”) is the owner of lands described in Schedule “A” (the “Easement Lands”);

And whereas the Commission has agreed to grant an easement to Canadian Niagara Power Inc. (“CNP”) over the Easement Lands in perpetuity for the purpose of aerial electrical transmission lines;

Now therefore pursuant to section 7 of the Niagara Parks Act, R.S.O. 1990, c. N.3, as amended, approval is hereby given to the Commission:

1. to grant an easement to CNP over the Easement Lands in perpetuity for the purpose of aerial electrical transmission lines; and
2. to execute such documents as may be necessary for that purpose.
