Designation

The Environmental Assessment Act (Act) allows for a project to be designated, by regulation, as a project to which the Act applies.

In March 2024, the ministry sought feedback from the public on a proposal to make a regulation that would designate York1’s proposed waste management project as a Part II.3 project under the Act and make it subject to comprehensive environmental assessment requirements. All comments received were carefully considered before a decision was made.

With the regulation in place, a comprehensive environmental assessment (the highest level of environmental assessment in Ontario) must be undertaken before the project can be implemented.

The process requires the assessment of potential environmental impacts and public consultation, and the project cannot be implemented unless a decision is made by the Minister of the Environment, Conservation and Parks, with the approval of the Lieutenant Governor in Council, to give approval under the Act to proceed with the project.
