Minister’s Order

Whereas subsection 13.3 (1) of the Safety and Consumer Statutes Administration Act, 1996 (the “SCSAA”) provides that the Minister may, by order, require a designated administrative authority to establish one or more advisory councils and include, as members of an advisory council, representatives of the public, consumer groups, businesses or government organizations and other persons as the Minister determines;

And whereas the Travel Industry Council of Ontario (“TICO”) is designated as the administrative authority for the purpose of administering the provisions of the Travel Industry Act, 2002 and the regulations made under that Act;

And whereas TICO is required to exercise its powers and duties in such a manner as to protect the public interest and to comply with the principle of maintaining a fair, safe and informed marketplace.

And whereas an order requiring an advisory council to be established provides a forum to enable TICO to obtain advice and input from key stakeholders to make informed decisions related to its consumer protection mandate;

Now therefore pursuant to subsection 13.3 (1) of the SCSAA I hereby make the following Order:

  1. In this order,
    • "travel agent” and “travel wholesaler” have the same meaning as in the Travel Industry Act, 2002.
    • “Board” means the board of directors of TICO.
  2. TICO shall establish an advisory council comprised of members representing the interests of travel agents and travel wholesalers. The advisory council shall include members who are directors, officers, employees, members or agents of industry associations representing the interests of travel agents and travel wholesalers, as well as one member from TICO’s Board who has been drawn from the travel sales sector. In addition, the advisory council may include members from any of the following classes of persons:
    1. travel agents.
    2. travel wholesalers.
    3. individuals who are directors, officers, employees or agents of travel agents or travel wholesalers.
  3. TICO shall take the necessary steps to implement this Order by no later than January 1, 2024.
  4. This Order comes into effect on the day it is made.
