Full-time appointees to adjudicative clusters, adjudicative tribunals and regulatory agencies

  1. The rate of remuneration of full-time appointees who held office on or after April 1, 2016 and before the date this Order in Council is made shall be increased by 6.4% in respect of their appointment(s) during the period commencing April 1, 2016 and ending March 31, 2017.
  2. Full-time appointees appointed to hold office on or after the date this Order in Council is made and before April 1, 2017 shall be remunerated in accordance with Table 1 below:

  1. Full-time appointees set out in paragraphs 1 and 2 who hold office on April 1, 2017 shall have their rate of remuneration in effect on March 31, 2017 increased by 1.4% effective April 1, 2017.
  2. Full-time appointees appointed to hold office on or after April 1, 2017 shall be remunerated in accordance with Table 2 below:

  1. Despite paragraphs 2 and 4, a full-time appointee who is appointed to a different adjudicative tribunal or regulatory agency shall, upon appointment to that adjudicative tribunal or regulatory agency, be paid the rate of remuneration applicable to their most recently completed appointment if their most recently completed appointment paid a higher rate of remuneration, and one of the following conditions is met:
    1. at the time that recently completed appointment ends, they are already cross-appointed to another adjudicative tribunal or regulatory agency that would have a lower rate of remuneration based on the term of appointment;
    2. they are appointed to the same position (i.e. as a member, vice-chair, chair or associate chair) at a different adjudicative tribunal or regulatory agency within 12 months of the end of that recently completed appointment.

In such a case, the higher rate of remuneration from their most recently completed appointment, as adjusted by any revisions under paragraph 3, if applicable, will continue until it is matched by the rate applicable to the First term (2 years), Second term (next 3 years), or Third term (final 5 years) of their cross-appointment or new appointment.
