Declaration Order Amending
Declaration Order – Toronto Waterfront Revitalization Corporation's Toronto Waterfront Parks

Having considered the amendments made to the EAA as part of the covid-19 Economic Recovery Act, 2020, S.O. 2020, c. 18 and the proposal to proclaim certain of those amendments which will repeal Part II of the Environmental Assessment Act and bring into force Part II.3 of the Act, and the proposal to make a regulation to designate certain enterprises and activities as Part II.3 projects and exempt certain of these;

Having regard to the amendments that are to be proclaimed and the proposed regulation and the importance of aligning the activities exempted by the declaration order entitled Toronto Waterfront Revitalization Corporation's Toronto Waterfront Parks made December 7, 2005 and approved by Order-in-Council number 1910/2005 (Toronto Waterfront Revitalization Declaration Order) with the proposed regulation;

Having considered that the above noted regulation, if made, will not come into force until the proclamation of subsection 3 (2) of Schedule 6 to the covid-19 Economic Recovery Act, 2020, S.O. 2020, c. 18, and having provided that this amending order will not apply unless and until the proclamation is made;

Having been advised that the injury, damage or interference to the persons and property that would have resulted from the Act applying to the class of undertakings to which the Toronto Waterfront Revitalization Declaration Order applied and that are set out in the recitals in that Order, continue to apply to the undertaking to which the Order, as amended, will apply; and,

Having considered the purpose of the Act and the public interest;

The undersigned is of the opinion that it is in the public interest to amend the above referenced declaration order and pursuant to s.3.2 of the Act the order is amended as follows:

  1. Condition 1 and Figure 1 attached to that condition are revoked and replaced with the following:
    This order applies to park development and redevelopment that is undertaken by TWRC or any agents working on behalf of TWRC along the Toronto waterfront in the Lake Ontario Park area, which is identified on the map and is incorporated into this Order as Appendix A.
  2. Condition 2 is revoked and replaced with the following as condition 2:
    Where any activity which is declared not subject to the Act under this order, is being carried out as or is part of an enterprise or activity in respect of which approval has been given under the Act, the activity shall be carried out in accordance with any terms and conditions in the approval to proceed as well as the conditions of this order.
  3. Condition 3 is amended to remove any reference to “or exemption order” and replace it with “or other exemption”.
  4. Condition 4 is amended to remove the phrase “as part of the Toronto Waterfront Parks” and replace it with “of the Lake Ontario Park area” and to remove the phrase to “future park development and”
  5. Condition 5 is amended to (i) remove the phrase “proposed parks” and replace it with “the development or redevelopments of a park in the Lake Ontario Park area”; and (ii) to remove the phrase “Toronto Waterfront Parks” and replace it with “development or redevelopment of a park in the Lake Ontario area”.
  6. Condition 6 is amended to (i) remove the phrase “related to the Toronto Waterfront Parks” and replace it with “that form part of the activities to which this order applies”; and (ii) to replace the reference to “Ministry of Natural Resources” with “Ministry of Natural Resources and Forestry”.
  7. Condition 7 is revoked and replaced by the following as condition 7:
    TWRC shall consult with the Ministry of Citizenship and Multiculturalism prior to the detailed design phase of the Lake Ontario Park area and prepare a Cultural Heritage Evaluation Report for the Lake Ontario Park area to be submitted to and by a time prescribed by the Ministry of Citizenship and Multiculturalism. In addition, TWRC shall immediately contact the Mississauga of the Credit First Nation should any burial or village sites be found during the preparation of the Cultural Heritage Evaluation Report or during construction.
  8. Condition 8 is amended to remove the phrase “of the proposed parks” and replace it with “taking place under this order.”
  9. Condition 11 is amended to remove both references to “each individual park” and replace each reference with “for the development and redevelopment of the Lake Ontario Park area”.
  10. The reference to the “Ministry of Environment” in condition 10 is replaced by the “Ministry of Environment, Conservation and Parks” and references in conditions 11 and 12 to the “Director of the Environmental Assessment and Approvals Branch of the Ministry of the Environment” are replaced with “Director of the Environmental Assessment Branch of the Ministry of Environment, Conservation and Parks”.
  11. This amending order applies upon the coming into force of subsection 3 (2) of Schedule 6 to the covid-19 Economic Recovery Act, 2020,
