National Instrument 94-102 Derivatives: Customer Clearing and Protection of Customer Collateral and Positions

On July 3, 2017, the following rule came into force under the Securities Act:

  • National Instrument 94-102 Derivatives: Customer Clearing and Protection of Customer Collateral and Positions (NI 94-102).

NI 94-102 relates to central counterparty clearing and contains requirements to ensure that the clearing of over-the-counter derivatives is carried out in a manner that protects customer’s positions and collateral, as well as improve derivatives clearing agencies’ resilience to default by a clearing member.

Order in Council

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and concurrence of the Executive Council, orders that:

O.C. 286/2020

Pursuant to subsections 2(2), 5(1) and 8(1) of the Executive Council Act, and despite any provision of a statute or Order in Council, responsibility for the administration of the Line Fences Act is hereby assigned and transferred from the Minister of Municipal Affairs and Housing to the Minister of Agriculture, Food and Rural Affairs as of April 1, 2020.

Further, the Appendix of Order in Council O.C. 1142/2018 dated October 22, 2018 and the Appendix of Order in Council O.C. 1157/2018 dated October 22, 2018, are hereby revised and shall be interpreted accordingly.

Pursuant to subsections 2(2), 5(1), and 8(1) of the Executive Council Act, and despite any provision of a statute or Order in Council, the Minister of Economic Development, Job Creation and Trade’s powers, duties, functions and responsibilities in respect of the Ontario Immigration Act, 2015 and the Ontario Immigrant Investor Corporation and the administration of the Ontario Immigration Act, 2015 are hereby assigned and transferred from the Minister of Economic Development, Job Creation and Trade to the Minister of Labour, Training and Skills Development.

Further, Order in Council O.C. 1790/2019 dated November 28, 2019 and Order in Council O.C. 2/2019 dated January 17, 2019 are hereby revised and shall be interpreted accordingly.
