Sheriff’s Sale of Lands

under and by virtue of a Writ of Seizure and Sale issued out of the Superior Court of Justice at Toronto, Ontario dated October 1, 2020, Court File Number CV-08-357827-0000, and the Orders of the Honourable Justice D. L. Corbett dated November 22, 2017, August 31, 2020 and September 28, 2020 (collectively, the “Judicial Orders”) to me directed, against the real and personal property of Ouaida Group Ltd., Defendant(s), at the suit of Sami Osman El Jundi and Lina Muskawi, Judgment Creditors, I have seized and taken in execution all the right, title, interest and equity of redemption of Ouaida Group Ltd, Defendant(s) in and to:

PT LT 4 CON 4 S OF dover RD dunn PT 1 18R3943; haldimand county; PIN: 38131-0106, the property municipally known as 3129 lakeshore road, dunnville.

All of which said right, title, interest and equity of redemption of Ouaida Group Ltd, Defendant(s), in the said lands and tenements described above shall be offered for sale pursuant to the Judicial Orders by a sealed bid auction subject to the terms and conditions set out below.

Signed bids must be submitted in a complete and clear manner and must be accompanied by a deposit in the form of a money order, bank draft or a cheque certified by a bank or trust corporation payable to the Minister of Finance.

Signed bids must be enclosed in a sealed envelope labelled “Sheriff’s Sale, 3129 lakeshore road, dunnville

Signed bids must clearly and legibly include the following:

  • Amount of bid
  • The address of the property of which the right, title, interest and equity of redemption is being sold. The address being 3129 lakeshore road, dunnville, Ontario
  • Name and address of the proposed purchaser
  • Daytime phone numbers and email address of the proposed purchaser or authorized agent
  • Bids must be received by the Sheriff at the Superior Court of Justice in Cayuga located at 55 Munsee Street North, Ontario, NOA 1EO no later than 3:00 p.m. local time on Thursday, November 12, 2020.
  • Bids received after 3:00 p.m. on Thursday, November 12, 2020 will not be considered.

terms and conditions:

The purchaser to assume responsibility for all mortgages, charges, liens, outstanding taxes, and other encumbrances. No representation is made regarding the title of the land or any other matter relating to the interest to be sold.

Vacant possession is not included in the sale of this property. Responsibility for ascertaining these matters rests with the potential purchaser(s).

Pursuant to the Judicial Orders, the sale is subject to the approval of the court. The court may reject any or all bids that do not, in the court’s absolute discretion, reflect the fair market value of the equity of redemption of the lands and premises.

Further to the Judicial Orders, Certificate of Pending Litigation registered on title to the property as Instrument Number CH79763 shall be discharged from title by the Judgment Creditor, Sami Osman El-Jundi upon approval of the Sheriff’s sale of the property by the court, and payment in full of the purchase price.

terms:

  • Deposit 10 % of bid price or $5,000.00, whichever is greater to be submitted with sealed bid
  • Deposit must be in the form of a certified cheque, bank draft or money order made payable to the Minister of Finance.
  • The deposit made by the successful bidder will be non-refundable and will be applied to the purchase price
  • The successful bidder will be notified within 5 days of approval of the sale by the court, by mail and/or email, and telephone to the address, telephone number and email provided on the successful bid.
  • The successful bidder will have ten (10) business days from the date notified, to pay the balance of the purchase price at the Courthouse.
  • All payments to be made in cash, certified cheque or bank draft made payable to the Minister of Finance
  • The Sheriff will provide a Deed Poll only upon satisfactory payment in full of purchase price.
  • Deposit to be returned to the unsuccessful bidders, 10 business days after the bids are opened, by mail to the address provided by the unsuccessful bidders.

this sale is subject to cancellation without further notice up to the time of satisfation of the sale terms by a successful bidder.

Note: No employee of the Ministry of the Attorney General may purchase any goods or chattels, lands or tenements exposed for sale by a Sheriff under legal process, either directly or indirectly.
