under and by virtue of Writs of Seizure and Sale issued out of the Superior Court of Justice, Family at Perth, Ontario dated June 6, 2016, Court File Number 649/13 (Execution No. 16-0000153) and July 5, 2016, Court File Number 649/13 (Execution No. 16-0000184), and Writ of Seizure and Sale issued out of the Superior Court of Justice, Civil at Ottawa dated December 1, 2015, Court File Number 15-65916 (Execution No. 15-0000299) and the Orders of the Honourable Justice J. Johnston dated August 25, 2017 (Court File No. CV-041/16) and October 15, 2021 (Family Court File No. 649-13) in the Superior Court of Justice, (the “Judicial Orders”) to me directed, against the real and personal property of Kevin James Donald Rintoul, at the suit of Betty Szyngiel and the suit of Augustine Bater Binks LLP, Judgment Creditors, I have seized and taken in execution all the right, title, interest and equity of redemption of Kevin James Donald Rintoul in and to:

PT LT 12 CON 4 ramsay as in RS178155; town mississippi mills, PIN 05104-0100 (LT)

and

east half LT 11 CON 3 ramsay, except PT 1 & 2, 27R6214; town mississippi mills, PIN 05104-0133(LT)

hereinafter the “Properties”

All of which said right, title, interest and equity of redemption of Kevin James Donald Rintoul in the Properties shall be offered for sale pursuant to the Judicial Orders by a sealed bid auction subject to the terms and conditions set out below. The Properties shall be sold together taking into account any priority rights of execution creditors over subsequent mortgages or charges pursuant to s. 14 of the Creditors’ Relief Act, 2010, and subject to the approval of the court

The signed bids must be submitted in a complete and clear manner and must be accompanied by a deposit in the form of a money order, bank draft or a cheque certified by a bank or trust corporation payable to the Minister of Finance.

Signed bids must be enclosed in a sealed envelope labelled “Sheriff Land Sale, Old Perth Road, B & C”

Signed bids must clearly and legibly include the following:

  • Amount of bid for both Properties
  • The address of the Properties of which the right, title, interest and equity of redemption is being sold. The address being: “Old Perth Road – PIN #051040133 and Old Perth Road (Landlocked)”
  • Name and address of the proposed purchaser
  • Daytime phone numbers and email address of the proposed purchaser or authorized agent

Bids must be received by the Sheriff at the Superior Court of Justice in Perth located at 43 Drummond Street East, Ontario, K7H 1G1 no later than 3:00 p.m. local time on Tuesday, November 30, 2021.

Bids received after 3:00 p.m. on Tuesday, November 30, 2021 will not be considered.

terms and conditions:

The purchaser to assume responsibility for all mortgages, charges, liens, outstanding taxes, and other encumbrances. No representation is made regarding the title of the land or any other matter relating to the interest to be sold.

Vacant possession is not included in the sale of this property. Responsibility for ascertaining these matters rests with the potential purchaser(s).

Pursuant to the Judicial Order, the sale is subject to the approval of the court. The court may reject any or all bids that do not, in the court’s absolute discretion, reflect the fair market value of the equity of redemption of the lands and premises.

  • Deposit 10 % of bid price or $5,000.00, whichever is greater to be submitted with sealed bid
  • Deposit must be in the form of a certified cheque, bank draft or money order made payable to the Minister of Finance.
  • The deposit made by the successful bidder will be non-refundable and will be applied to the purchase price
  • The successful bidder will be notified within 5 days of approval of the sale by the court, by mail and/or email, and telephone to the address, telephone number and email provided on the successful bid.
  • The successful bidder will have ten (10) business days from the date notified, to pay the balance of the purchase price at the Courthouse.
  • All payments to be made in cash, certified cheque or bank draft made payable to the Minister of Finance
  • The Sheriff will provide a Deed Poll only upon satisfactory payment in full of purchase price.
  • Deposit to be returned to the unsuccessful bidders, 10 business days after the bids are opened, by mail to the address provided by the unsuccessful bidders.
