Order in Council 932/2020

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Lieutenant Governor in Council has by regulation under the Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009, designated the Board of Negotiation, the Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal as a cluster;

And whereas the cluster is to be known as Ontario Land Tribunals;

And whereas the Lieutenant Governor in Council finds it necessary and convenient to appoint an Executive Chair of Ontario Land Tribunals;

Therefore, pursuant to subsection 16(1) of the Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009, Marie Hubbard of Newcastle be appointed as full-time Executive Chair of Ontario Land Tribunals for a fixed term of one year, effective July 1, 2020.

Further, in accordance with subsection 17(1) of the Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009, the Executive Chair shall have the powers, duties and functions assigned to the Chair of each adjudicative tribunal in Ontario Land Tribunals by that Act or any other Act or by any regulation, order in council, ministerial or Management Board of Cabinet directive.

And further, pursuant to subsection 27(1) of the Expropriations Act, subsection 24(1) of the Ontario Heritage Act, subsection 1(2) of the Environmental Review Tribunal Act, 2000, subsection 3(1) of the Local Planning Appeal Tribunal Act, 2017 and subsection 6(2) of the Ministry of Natural Resources Act, Marie Hubbard of Newcastle be further appointed as a member of the Board of Negotiation, the Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal, respectively, for concurrent fixed terms of one year, effective July 1, 2020.

And further, whereas Marie Hubbard was appointed as full-time member and Associate Chair of the Local Planning Appeal Tribunal for a fixed term of two years, effective February 21, 2020, by Order in Council O.C. 53/2020;

Therefore, pursuant to clause 77(a) of the Legislation Act, 2006, subsection 3(1) of the Local Planning Appeal Tribunal Act, 2017 and subsection 16(2) of the Adjudicative Tribunals Accountability, Governance and Appointments Act, 2009, Order in Council O.C. 53/2020 be revoked effective July 1, 2020.
