Minister’s directive

To: the ontario energy board

I, Glenn Thibeault , Minister of Energy, hereby amend the March 26, 2014 Directive to the Ontario Energy Board (“CDM Directive”) as follows, pursuant to my authority under sections 27.1 and 27.2 of the Ontario Energy Board Act, 1998:

  1. Paragraph 3 of the CDM Directive is amended by repealing and replacing 3.i) with the following:
    1. that the Board shall annually review and publish the verified results of
      1. each Distributor’s Province-Wide Distributor CDM Programs and Local Distributor CDM Programs, and
      2. measures used by a Distributor to maximize the efficiency of its new or existing distribution system infrastructure, excluding general plant buildings and fixtures, where the IESO has confirmed that the resulting electricity reductions are counted towards the target allocated to the Distributor by the IESO under the Minister of Energy’s direction issued on March 31, 2014, as amended,

    and report on the progress of Distributors in meeting their CDM Requirement;

  2. Paragraph 3 of the CDM Directive is amended by adding a new 3.iii) and subparagraph 3.iii is renumbered accordingly:
    1. Notwithstanding the definition of CDM set out in subparagraph 3.ii., CDM shall be considered to exclude behind the meter customer generation that uses fossil fuels purchased from or otherwise supplied by a third party as a primary fuel source, where the application for the project is received by the IESO on or after July 1, 2018.  For greater clarity, CDM shall continue to be inclusive of behind the meter generation, where the generation of electricity is primarily from heat or fuel that is a waste by-product of a facility.
  3. In all other respects, the CDM Directive shall remain in full force and effect.
