Multilateral Instrument 91-102 Prohibition of Binary Options

On December 12, 2017, Multilateral Instrument 91-102 Prohibition of Binary Options (MI 91-102) became effective under the Securities Act.

The purpose of MI 91-102 is to protect would-be investors from becoming victims of binary options fraud and from an illegal promotion of extremely high risk products. MI 91-102 will achieve this goal by raising awareness among investors that the sale of these products is illegal and by disrupting the distribution of these products, including its facilitation through payment processing and advertising.

MI 91-102 prohibits advertising, offering, selling or otherwise trading a binary option having a term to maturity of less than 30 days with or to:

  • an individual, and
  • a person or company that is created, or is used, solely to trade a binary option.

MI 91-102 sets out a definition of “binary option” that is intended to capture a range of products that are commonly called binary options, or that are similar to products that are commonly called binary options, regardless of how they are named.

Order in Council

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and concurrence of the Executive Council, orders that:

whereas pursuant to subsection 2(1) of the Executive Council Act, R.S.O. 1990, c. E.25, a member of the Executive Council has been appointed under the Great Seal to hold office as the Minister of Advanced Education and Skills Development;

therefore, pursuant to subsections 2(2), 5(1) and 8(1) of the Executive Council Act:

Minister to preside over Ministry

  1. The Minister of Advanced Education and Skills Development (the “Minister”) shall preside over a ministry known as the Ministry of Advanced Education and Skills Development (the “Ministry”).

Minister

  1. The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of advanced education and skills development and any other matters related to the Minister’s portfolio.
  2. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had been previously assigned and transferred to the Minister of Training, Colleges and Universities including the powers, duties, functions and responsibilities assigned and transferred to the Minister under Order in Council O.C. 1337/2016 dated September 14, 2016 and Order in Council O.C. 831/2014 dated April 30, 2014, and such powers, duties, functions and responsibilities are assigned and transferred accordingly including but not limited to the powers, duties, functions and responsibilities of the Minister of Training, Colleges and Universities in respect of the following Acts:

Attendant Care Hourly Rate Guideline

Introduction

This Guideline is issued pursuant to s. 268.3 of the Insurance Act and is incorporated by reference in s. 19 (2) (a) of the Statutory Accident Benefits Schedule – Effective September 1, 2010 (SABS).

Purpose

This Guideline establishes the maximum expense that automobile insurers are liable to pay under the SABS related to attendant care services, and applies only to accidents that occur on or after January 1, 2018.

The maximum hourly rates applicable to accidents occurring before January 1, 2018 continue unchanged. For example, the rates applicable to accidents occurring on or after October 1, 2017 and before January 1, 2018 are governed by Superintendent’s Guideline No. 02/17. See the Financial Services Commission of Ontario website for previous Superintendent’s Guidelines.

Insurers are not prohibited from paying above the maximum hourly rates established in this Guideline.

Collateral Benefits

In respect of any expense referenced in this Guideline, the amount which an insurer would otherwise be liable to pay is subject to reduction by that portion of the expense for which payment is reasonably available under any insurance plan or law or under any other plan or law.

Administration Fees

The hourly rates referred to in s. 19 (2) (a) of the SABS and this Guideline include all administration costs, overhead, and related costs, fees, expenses, charges and surcharges that have the result of increasing the maximum hourly rates. Insurers are not liable for any administration or any other charges or surcharges that have the result of increasing the effective hourly rate beyond what is payable under this Guideline.

Maximum Fees

Automobile insurers are not liable to pay for expenses related to attendant care costs rendered to an insured person that exceed the maximum hourly rates set out below.
